Divorce spousal support, often called “alimony,” is determined based on various factors. Alimony is financial support paid by one spouse to the other after divorce to help maintain a similar standard of living. Spousal support isn’t automatic and is decided on a case-by-case basis.
Courts Consider Various Factors in Spousal Support
When determining spousal support, courts consider factors such as the length of the marriage, each spouse’s earning capacity and financial resources, the age and health of each spouse, and their contributions to the marriage, including homemaking and child-rearing responsibilities. Additionally, the court may consider any agreements made between the spouses regarding spousal support.
Temporary and Permanent Spousal Support
The duration of spousal support can vary. It may be temporary or permanent, depending on the circumstances of the marriage and the needs of each spouse. Temporary spousal support is typically awarded for a specific period to allow the recipient spouse time to become self-supporting. Permanent spousal support may be awarded if one spouse is unable to achieve financial independence due to factors such as age, health, or limited earning capacity.
Spousal Support Can be Modified
Modification of spousal support orders is possible if there is a significant change in circumstances, such as a change in either spouse’s income or financial situation. Either spouse can request a modification of spousal support, but the court will consider whether the change is substantial and unforeseen.
